General terms and conditions of sale
Article 1 : Preamble
These general terms and conditions of sale apply exclusively between the company operating Ange Paradis, Route Ampère, Poleymieux (69250) (hereinafter referred to as "We") and any person visiting or making a purchase via the www.ange-paradis.com website (hereinafter referred to as "You").
Any Internet user may read the General Terms and Conditions of Sale on the www.ange-paradis.com website (hereinafter referred to as the "Site"). These General Terms and Conditions of Sale may be subject to change, and the conditions applicable are those in force on the Site on the date you place your order.
Article 2 : Contract
2.1 Conditions for placing an order
You declare that you are at least 18 years of age and have the legal capacity or parental authorization to place an order on the Site.
Any order placed on the Site must correspond to the normal needs of a household.
2.2 Ordering
After placing your order, We will send You an e-mail confirming it. We will inform you when your items have been dispatched.
You may modify your order up to the date of dispatch.
Article 3 : Prices, availability and delivery
The prices displayed on the Site are in euros and do not include delivery charges, order processing costs or gift-wrapping costs. In accordance with the law, by virtue of the company's status, VAT is not applicable under article 293B of the French General Tax Code
We can accept your orders while stocks last. We inform you of the availability of items sold on the Site on the information page for each item.
If, despite our vigilance, the items are unavailable, We will inform You by e-mail as soon as possible.
(i) In the event of unavailability within the time period indicated, We reserve the right to offer You a replacement item of equivalent quality and price. In this case, We will bear the cost of any returns resulting from the exercise of the right of withdrawal. In the event that We are unable to provide You with an item of equivalent quality and price, or if You do not wish to receive an item of equivalent quality and price, You may cancel your order.
(ii) In the event of permanent unavailability, and if We are unable to provide You with an item of equivalent quality and price, Your order will be automatically cancelled.
Despite our best efforts, it is possible that a small number of items on Our Site may contain a pricing error. Please be assured, however, that We will check the prices during the shipping process. If the corrected price is lower than the price displayed on the Site, We will apply the lower price and send You Your item. If the corrected price is higher than the price displayed on the Site, We will inform You and cancel your order, unless You choose to accept the order at the new price.
Free delivery applies to all orders equal to or greater than the price indicated, if free delivery is offered during your purchase period. To benefit from free delivery, simply place an order for an amount greater than or equal to the indicated price.
We reserve the right to increase or decrease free shipping.
Free delivery will be applied to standard deliveries by post. Special deliveries such as Colissimo or Chronopost do not qualify for free delivery.
The average delivery time for our figurines is 72 hours, and we do our utmost to meet this deadline to your complete satisfaction. However, this delivery time does not constitute a commitment on our part. We reserve the right to have a longer delivery time than the one mentioned on the site. We are also not responsible for carrier delays, loss or damage. It is also your responsibility to check the parcel carefully before accepting it on receipt.
When you place an order, the average preparation and delivery time may be extended, and we cannot be held responsible for this.
You will usually receive a message from us informing you of this. We reserve the right to take longer than the average lead time to prepare and dispatch your order.
Special orders for professionals or orders requiring large quantities of the same product may take longer to process. We reserve the right to take longer to prepare and dispatch these orders, without being held responsible for this extra time. We reserve the right to cancel any such order without reason or cause.
If an article is no longer available in our stock, but a similar model is available, we reserve the right to replace it without prior request. The similar item would be in all respects similar in size, weight, and color, the only differences would be different postures of the angel. The angel would be 95% similar to the one ordered. This argument is intended to facilitate the management of orders and enable the customer to receive his parcel more quickly, rather than putting the order on hold for a detail on the figurine. We cannot be held responsible if a figurine is sent that is similar in every respect to the original product.
Article 4 : Customs duties
Any order placed on the Site and delivered outside France may be subject to taxes and customs duties that are imposed when the package reaches its destination. These customs duties and taxes are your responsibility. We are not obliged to check and inform You of applicable customs duties and taxes. To find out about them, We advise You to contact the relevant authorities in your country.
Article 5 : Payment
You may pay by credit card.
Cards issued by banks domiciled outside France must be international bank cards. In the event of payment by credit card, the amount of your order will only be debited at the time of dispatch of your items.
In the event that You are late in paying the price, We shall be entitled to claim late payment interest calculated on the basis of the legal rate in force and applicable from the date of the summons to pay.
Article 6 : Returns
You have the right of withdrawal of fourteen (14) days provided by law to return items to Us without having to justify your reasons.
If We agree to replace a damaged or non-conforming product, as an exceptional measure, You must return this product to Us within 15 days of the date on which We confirmed to You that We would proceed with its replacement. In the event of failure to comply with Your obligation to return the damaged or non-conforming product within said 15-day period, We reserve the right to debit the credit card You used for Your order with an amount equivalent to the price (to which VAT is added) of the damaged or non-conforming product that You did not return to Us. In this case, a second sale under suspensive condition will be considered as having been made by Us. This suspensive condition will be satisfied if, at the end of the 15-day period following the date on which We sent You a replacement product, the damaged or non-conforming product has not been returned to Us.
We do not accept returns of badly packed or broken products (we check all our items before they are sent to your home). It is your responsibility to check that your products have not been broken in transit by checking the condition of your goods with the Post Office when you receive them. However, in exceptional circumstances, we may grant an exchange or refund on a case-by-case basis, with proof of damage (photos, etc.). Our customer service department reserves the right to grant or refuse an exchange on a case-by-case basis.
If a product is broken when you receive your order, you must refuse the parcel.
Returns must be received in perfect condition, unpacked and undamaged. We reserve the right to reimburse you if the returned goods are not in as-new condition. The customer is responsible for return shipping costs. A handling fee may also apply. It is your responsibility to pack the returned item in sufficient and appropriate packaging to ensure that it is not damaged during the return journey. If the product arrives broken, the buyer is fully responsible and no refund can be claimed.
Return postage is charged and will be deducted from the refund amount of the order, except in the case of exceptions and trade discounts. Transaction fees are also deducted and constitute processing costs.
Returns are possible on standard orders for up to 14 days.
For special orders and fairy-type products, returns are not possible because the conditions of the order make it a personalized order: creation of special fairy-type orders or large quantities of the same product (more than 3). These orders are therefore considered firm and no cancellation or return requests can be taken into account for this type of order.
Article 7 : Reservation of ownership
The goods delivered remain our property until they are dispatched to the carrier, once You have paid the price.
Article 8: Warranties and liability
We decline all responsibility in the event that the item delivered does not comply with the legislation of the country of delivery other than France.
We undertake to take all the care in use in the profession for the implementation of the service offered to the customer. Nevertheless, we shall not be held liable in the event of failure to meet our contractual obligations due to an act of God or force majeure as defined by the case law of the French courts.
We shall not be held liable in the event of a delay due to the publisher or supplier being out of stock. Furthermore, we shall not be held liable in the event of any insubstantial differences between the photographs, texts and illustrations presenting the items on our Site and the items ordered.
We make every effort to provide the services described in these General Terms and Conditions of Sale. We are liable for any direct and foreseeable damage at the time of use of the Site or the conclusion of the sales contract between Us and You. In no event shall We be liable to any professional for loss of profits, loss of business, loss of data or loss of revenue or any other indirect damage or damage which was not foreseeable at the time of use of the Site or the conclusion of the sales contract between Us and You.
Our statues are for indoor use only and are not guaranteed for outdoor use. If you wish, you may use a special outdoor varnish to protect statues outdoors against bad weather, including frost (resin varnish, multi-material varnish available in DIY stores). Under no circumstances can we be held responsible if statues are damaged as a result of outdoor use or under non-normal conditions.
Goods travel under the recipient's responsibility. We cannot be held responsible for breakage caused by carriers. All orders are checked before dispatch to ensure that the part is in undamaged condition and of a quality conforming to our standards. In the event of problems upon receipt, we recommend that you contact our customer service department by email.
The above limitation of liability does not apply in the event of fraud or gross negligence on Our part, in the event of personal injury or liability for defective products, in the event of eviction and in the event of non-conformity (including hidden defects).
Article 9: Site access license
We grant You a limited license to access and use the Site for your personal use. Under no circumstances may You download or modify all or part of this Site without Our express written authorization. These terms and conditions of sale are governed by French law and by the Vienna Convention on Contracts for the International Sale of Goods. All disputes relating to the commercial relationship between You and Us are subject to the non-exclusive jurisdiction of the French courts.
Article 13 : Conditions for free delivery and 3-day delivery
3-day delivery applies only to our products in stock. In the event of non-stock, we will notify you by e-mail. We reserve the right to cancel your order if the product is no longer available. We reserve the right to deliver within a reasonable time if our products are not immediately available.
If the order is not to your satisfaction, we will refund your order in full, with the exception of the cost of returning the figurine to you, provided it is in good condition. We cannot be held responsible for breakage during the return of the product, or for any other type of breakage. All our figurines are, without exception, checked by a person who ensures that the statue is in perfect condition before shipping. For this reason, any breakage or defect on one of our products will not be reimbursed, and we cannot be held responsible for breakage or poorly protected packaging.
